Barnham Broom Terms and Conditions
Barnham Broom Golf Club Ltd (hereafter “the Company”)
1. Acceptance as a member We the Company have absolute discretion over whether to enter into this agreement and to accept your application for membership of the Club.
2. Membership
2.1 People living at the same address and making payment together may apply for joint membership for which a discount may be available, subject to proof of joint address.
2.2 Responsibility for all subscriptions and payments will be with the Head Member.
2.3 All correspondence and request to change the Membership must be through the Head Member.
2.4 Additional members must abide by all the terms within this agreement.
2.5 Certain types of membership do not allow you to use all of the Club’s services and facilities. At our discretion, we may allow you to use services and facilities not included in your type of membership on payment of an additional charge.
2.6 As a member you agree to comply with the rules of membership which are displayed prominently in the club and relate to opening hours, use of the facilities and your conduct.
2.7 We may (unless stated elsewhere in this agreement) make reasonable changes to these rules at any time provided we give you advance notice of the changes.
2.8 We may increase monthly subscription at any time and for any amount provided we see fit provided we give you 30 days notice in writing.
3. Membership Fees
3.1 You will remain a member of the Club for the Minimum Period as specified overleaf after which your membership of the Club will continue for further consecutive one month periods unless your Membership is cancelled by you giving the Club not less than one month’s notice in writing.
3.2 You are entitled to use the facilities at the Club included with the Membership Type specified overleaf details of which have been provided to you and which are available on request at the Club. The charges for use of any additional facilities not included within the Membership Type specified overleaf shall be as indicated to you by the club from time to time prior to you using such additional facilities.
3.3 Your Membership Agreement is offered in a way on a monthly subscription, in advance by Direct Debit or by Annual fee in advance.
3.4 Monthly subscription packages may include: a Joining Fee, a oneoff payment that is not repayable providing the membership stays current, this fee would be due in full if the membership was cancelled and you subsequently decide to rejoin the facilities; a Prorata payment, which is calculated on a daily rate for the fees due until your first Direct Debit payment is made; 30 Day Notice Payment which covers your final month of membership i.e the first month in which your direct debit is not paid. This payment entitles you to use the facility for that month by way of a 30 Day Notice Period.
3.5 Annual advance payments may include a Joining Fee (see 3.4 above).
3.6 Annual memberships are renewable at the end of each year.
3.7 Annual memberships paid up-front are non-refundable.
4. Debt
4.1 Should your Direct Debit fail, for any reason whatsoever, you must endeavour to pay the debt immediately. If necessary, you must provide the Club with new Direct Debit details.
4.2 Should another person pay the Direct Debit on your behalf, you are solely liable to make payments due under this agreement, if for any reason the Direct Debit fails. If necessary, you must provide the Club with new Direct Debit details
4.3 If any debt is not cleared by the time the next payment is due, the Club may take that to mean you have served your 30 Day Notice Period and subsequently cancel your membership.
5. Termination
5.1 We can terminate your Membership immediately if:
a) You commit a serious or repeated breach of this Agreement or the Club rules or if that breach is capable of being remedied, it is not remedied within 7 days.
b) In our reasonable opinion your behaviour is likely to endanger other members, their guests or staff, or adversely affect the Centre or our reputation.
c) If any amounts you owe us remain unpaid 30 days after the due date; or
d) You provide us with details you know to be false when applying for Membership and those details reasonably affected our decision to grant you Membership.
5.2 If your membership is terminated we will not refund any fees whatsoever that have been paid in advance which related to a period after termination, or relates to Joining Fees, Pro-rata, 30 Day Notice Payments or any other administration charges.
5.3 Once your Membership has ended you will no longer be entitled to use the Club. You should return your membership card and should you attempt to use the Club we will refuse access.
6. Suspension
Should you wish to suspend your Membership you must make an application in writing to the Club. The suspension requested should be based on medical necessity and the Company reserve the right to charge a monthly suspension fee in respect of this period. Details available upon request.
7. Change of Membership Category
7.1 You may change your type of Membership package at any time, in person, at the facility. You will be asked to pay applicable fees including an administration fee.
7.2 No fees will be refunded in any circumstances.
8. Transfer of Membership
Your membership may be transferred subject to the following conditions:
a) The proposed transferee completes an application form.
b) The proposed transferee is acceptable to the Club (who shall not be bound to give any reason for refusal).
c) The proposed transferee submits a Direct Debit mandate in respect of the subscription due from the next due date.
d) An administration fee is payable.
e) The proposed transferee agrees to abide by the rules and regulations of the Club.
9. Opening Hours and Facilities
Details of the Club’s current opening hours and facilities are displayed in the Club. We may sometimes need to change opening hours or facilities available. If we need to do this we will, where reasonably possible, display notices in the Club notifying you of the change at least 2 weeks beforehand.
10. General
10.1 Through circumstances beyond our control or any reasons beyond reasonable control, we may be unable at times to provide our full range of services. This may be, for example, because of temporary closure of our premises due to fire or flood damage, we will do all we can to restore our services as soon as possible.
10.2 The Membership card issued to you will remain our property. We will charge you a reasonable fee to replace a lost or damaged card.
11. Conduct
11.1 The Company has the right to terminate or suspend a member’s membership for reasons relating to conduct as specified in the Club rules.
11.2 The Company has the right to prevent entry or reject from the Club anyone whose behaviour or appearance is, in its sole opinion, deemed by it to be unsuitable.
12. Privacy Policy
The personal date we hold on you includes your name, address, contact number(s), email address, gender, date of birth, handicap details and bank details (where applicable e.g Direct Debit payments). We use this information to allow us to fulfil our contractual obligations to you as a member in accordance with our Membership Terms and Conditions and Club Regulations. We may from time to time be required to share this information with our external data processors and Governing Body (e.g for handicap purposes) who adhere to our Privacy Policy.
